
Partner Migration

Partner migration is primarily delivered through Subclass 820/801, for applicants who apply onshore in Australia, and Subclass 309/100, for applicants who apply offshore.

The 820 and 309 visas are temporary partner visas, granted first to allow assessment of the relationship over time, while the 801 and 100 visas are the corresponding permanent partner visas, assessed after a qualifying period unless long-term relationship criteria apply.

Applications are assessed on four key aspects of the relationship: financial, social, household,
and commitment. Evidence must demonstrate that the relationship is genuine, ongoing, and
exclusive, and that the couple intend to live together on a permanent basis. The sponsor must
be an Australian citizen, permanent resident, or eligible New Zealand citizen and meet
sponsorship limitations and character requirements.
Health, character, and Public Interest Criteria apply to both applicant and sponsor.
Inconsistencies, insufficient evidence, or doubts about genuineness are the most common
refusal reasons, making thorough documentation and consistency critical throughout the
process.
